*Please note fees are subject to change and are wholly dependant on individual circumstances which should be discussed over a free enquiry*

 

Sales fees:

£0 - £200,000 = £500 + VAT

£201,000 - £350,000 = £595 + VAT

£351,000 - £500,000 = £665 + VAT

£501,000 - £650,000 = £745 + VAT

£651,000+ = £795 + VAT

Conveyancer's Fees and disbursements on a Sale:

  • Electronic money transfer fee £36.00 + VAT (per transfer)

  • ID checks £24.00 + VAT (per person)

In addition to the above we will need to obtain copy of the title documents from the land registry – usually these charges are around £20.00

Purchase:

£0 - £200,000 = £600 + VAT

£201,000 - £350,000 = £695 + VAT

£351,000 - £500,000 = £765 + VAT

£501,000 - £650,000 = £845 + VAT

£651,000+ = £895 + VAT

Conveyancer's Fees and disbursements on a Purchase:

  • Electronic money transfer fee £36.00 inclusive of VAT (per transfer)

  • Electronic ID checks £24.00 inclusive of VAT (per person)

  • Fee for acting on behalf of the mortgage lender is included free of charge when you instruct Cooklaw Solicitors Ltd

  • Search fees – these can vary depending on where you are buying the property but are likely to be between £200.00 – £290.00

  • HM Land Registry fee will depend on the value of the house you are buying and are set by the government but are between £20.00 and up to £950.00 for properties valued over £1,000,000.00 

House Purchase:

Our fees cover all the work required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property is in Wales.

 

In addition to the above we will need to obtain copy of the title documents from the land registry – usually these charges are around £20.00

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. There are certain disbursements which will be set out in the individual lease relating to the Property.

 

The disbursements which we anticipate will apply are set out separately below.

 

This list is not exhaustive and other disbursements may apply depending on the term of the lease. We will update you on the specific fees upon receipt and review of the lease from the seller’s solicitors.

Additional Leasehold costs and disbursements

We charge £200 + VAT if the property is in a block of flats and £100 + VAT if it is a flat within a converted house/building with no service charges or ground rent.

Some additional third party fees may include:

  • Notice of Transfer fee – This fee if chargeable is set out in the lease. Often the fee is between £50.00 – £250.00.

  • Notice of Charge fee (if the property is to be mortgaged) – This fee is set out in the lease. Often the fee is between £50.00 – £250.00.

  •  Deed of Covenant fee – This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £150.00 – £400.00

  • Certificate of Compliance fee – To be confirmed upon receipt of the lease, as can range between £150.00 – £350.00

  • Membership Certificate fee - This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £50.00 – £250.00

If the property you are selling is leasehold then there will be additional legal fees of £120.00 including vat and we will need to get a Leasehold information pack from the Freeholder and Management company – these fees are unregulated and not fixed but can be between £150.00 -£400.00 per pack

These fees vary from property to property and can on occasion be significantly more than the ranges given above. We can give you an accurate figure once we have sight of your specific documents.
You should also be aware that ground rent and service charge are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge as soon as this we receive this information.

Stamp Duty Land Tax

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC’s website or if the property is located in Wales by using the Welsh Revenue Authority’s website.

What is included in our charges?

The precise stages involved in the purchase of a residential property vary according to the circumstances. However, below we have suggested some key stages that would be included.

 

On a purchase:


• Take your instructions and give you initial advice
• Check finances are in place to fund purchase and contact lender’s solicitors if needed
• Receive and advise on contract documents
• Carry out searches
• Make any necessary enquiries of seller’s solicitor
• Give you advice on all documents and information received
• Go through conditions of mortgage offer
• Send final contract to you for signature
• Draft Transfer
• Advise you on joint ownership
• Obtain pre-completion searches
• Agree completion date (date from which you own the property)
• Exchange contracts and notify you that this has happened
• Arrange for all monies needed to be received from lender and you
• Complete purchase
• Deal with payment of Stamp Duty/Land Tax
• Deal with application for registration at Land Registry


On a sale:-


• Take your instructions and give you initial advice
• Obtain title documents and prepare and issue contract documents
• Obtain a redemption figure on any mortgage
• check information you have provided on the Property Information form and advise on any additional documentation or indemnity policies which may be needed
• Give you advice on all documents and information received
• Send final contract to you for signature
• Check the draft Transfer
• Agree completion date (date from which you cease to own the property)
• Exchange contracts and notify you that this has happened
• Arrange for all monies to be sent to your mortgage lender and to you
• Complete sale

How long will my house sale or purchase take?

How long it will take from your offer being accepted until you can move into your house will depend on a number of factors. The average process takes between 8-10 weeks. It can be quicker or slower, depending on the parties in the chain. For example, if you are a first time buyer, with a mortgage in principle, it could take 6 weeks. However, if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 3 – 6 months. In such, a situation additional charges would apply.


Our fee assumes that:
a. this is a standard transaction and that no unforeseen matters arise including for example (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction
b. this is the assignment of an existing lease and is not the grant of a new lease
c. the transaction is concluded in a timely manner and no unforeseen complications arise
d. all parties to the transaction are cooperative and there is no unreasonable delay from third parties providing documentation
e. no indemnity policies are required. Additional disbursements sill apply if indemnity policies are required and we make a charge of £30.00 plus vat to arrange each policy
