Why do you need an expert in new build conveyancing?
Buying a new build is much more complicated than buying other types of property. The conveyancing process is different and there are various complexities to take into consideration.
Buying ‘off plan’ is especially nuanced as the contracts are exchanged before the property is even built. This makes it necessary to check the paperwork very carefully to see what is included in the contract, warranties, planning permission and lease (it it’s a leasehold).
Typically, there are very tight timescales involved. As the buyer, you usually have to exchange contracts within four weeks of paying the reservation fee. Once the property is finished, you are served with a Notice to Complete and normally have 10 days to pay the balance.
Issues can also arise in relation to the developer. The build may be delayed beyond the anticipated completion date, or fail to comply with planning regulations and NHBC standards.
Because of the potential risks, you need a solicitor who has extensive experience in new build conveyancing. That’s us. We deal with a lot of new build conveyancing transactions. We know exactly what problems to look out for, and how to solve them with the least amount of stress possible.
What we do
When you instruct us to handle your New build conveyancing purchase, we will:
Check the contract and the lease (if applicable)
Complete local authority searches
Check for restrictive covenants
Check the building complies with planning regulations
Find out what is included in the sale
Check the property is connected to gas, water, drainage and electricity
Advise you about the long-stop completion date, which is the date you can get your deposit back if the sale has not been completed
Advise you about a snagging provision, which is written into the contract and forces the developer to rectify any issues identified with the property after completion
We are also on hand to deal with any additional issues that may occur. This might include where the developer fails to comply with planning regulations or the build does not pass the standards imposed by the warranty provider.
Buying a new build requires a conveyancer to act very quickly. We proactively work on your file so we’re ready to exchange and complete when the time comes. But we remain diligent, meticulously checking the details to protect your best interests.
With Cooklaw Solicitors, you’ll benefit from specialist legal advice throughout the entire conveyancing transaction. We are here to support and guide you through the process of buying a New build, all on a fixed fee basis.
